GENERAL TERMS AND CONDITIONS FOR THE USE OF THE VEHICLE RENT RESERVATION SYSTEM AND CAR TARGET RESERVATION SYSTEM

1. INTRODUCTORY PROVISIONS



Article 1

The general terms and conditions for the use of reservation system Vehicle Rent and reservation system Car Target establishes the rights and obligations of users and the company Modicus Ltd. as the agent, as well as terms and conditions for the use of reservation systems.

The issuer of these general terms and conditions is the company Modicus Ltd., Erjavčeva ulica 10,
1234 Mengeš - Slovenia, registered at the district court in Ljubljana, under the registration number 2011/17948, tax ID number 71826238, registration number: 3972542, web address: www.vehicle-rent.com, www.car-target.com

2. DEFINITION OF TERMS



Article 2

The terms in these General Terms and Conditions carry the meaning:

General terms and conditions: are always valid general terms and conditions for using the reservation system Vehicle Rent and reservation system Car Target

User: any individual or legal entity using Vehicle Rent reservation system or Car Target reservation system

Agent: company Modicus Ltd. which is the owner and manager of Vehicle Rent and Car Target reservation systems

Reservation system: Vehicle Rent and Car Target reservation systems, which enable the user to make car rental reservation through a web application

Car rental service providers: companies, which under previously defined conditions offer car rental through Vehicle Rent and Car Target reservation system

3. USER AGREEMENT



Article 3

The user making use of the reservation system agrees that he/she is familiar with all provisions of these general terms and conditions, that he/she is in full agreement with their content and that the provisions of the general terms and conditions bind him/her to the same degree as contractual terms.

The consent of the user is extended to the use of any other web page tabs which are accessed through the reservation system.

Disagreement with the content of general terms and conditions can be expressed by the user only in the case they cease to use the system immediately after visiting the reservation system; otherwise it is considered that they agree with the content.

The users agree to receive promotional messages by the agent on their e-mail address.
The user may revoke consent under this paragraph at any time and inform the agent through the e-mail address info@car-target.com.

7. COPYRIGHT PROTECTION NOTICE AND LIMITED LICENCE



Article 9

All information and data within the reservation system, including all content, text, graphics, images, trademarks, site structure, photographs, buttons, graphic images and computer code are copyrighted and available only for your private use. It is prohibited to modify, reproduce or distribute them.

The reservation system can only be used for private and not for commercial purposes unless given express written consent by the agent.

9. MAKING A RESERVATION



Article 12

The user is informed that the execution and payment of the reservation through the reservation system can be done in two ways:


The method of payment for reservation depends on the location and / or selected car rental service provider.

If any payment is required prior to the completion of the reservation process, the reservation system shall notice the user.  In such an event, the user is required to pay the balance to the car rental service provider directly. However, the user is always responsible for the payment of additional services / costs which were requested by the user, and is also responsible for all other costs related to vehicle renting or vehicle lessor.

To be able to use the car rental service provided through the reservation system, the user must use a credit card owned by the holder of the reservation.

At the time of booking being made by user, reservation system validates user credit card by processing an authorization of 1 GBP. Actual charge on customer credit card is made at the moment when booking gets confirmed by partner. The charge is being made in reservation system base currency, in GBP (British pound). By accepting these terms and conditions customer agrees that if the amount is displayed in different currency than GBP (British pound) and if user credit card is being processed in any other currency than GBP, due to currency exchange rate, actual amount charged on their credit card may be different from the amount being displayed on the web. Currency exchange rate in reservation system is being refreshed and uploaded once a day from a third party source and may be different from current situation on currency market.

By making a reservation user agrees on that there are sufficient funds on credit card for reservation to be finalized and credit card being charged for amount of the deposit. If the payment gets declined due to insufficient funds on the credit card, agent can cancel the booking without any prior notice.

 

10. AMENDMENTS OF RESERVATION



Article 13

Amendments to a booking will be subject to a 5 EUR amendment fee per amendment made, except in the case the amendment is within 72 hours of the booking being placed on the website.

Amendments in reservation can be made only through the support application in the reservation system, at which the agent cannot guarantee that the changes will be processed.
Amendments cannot be accepted and carried out after the vehicle has already been acquired. The agent is not obliged to reimburse the money to the user in the event of early completion of car rental service.

Extension of car rental service after the hire vehicle is picked up(a date which is beyond the date framework on the voucher) may only be conducted with a selected car rental service provider who shall also account for the extension. Extension of car rental service before the rental starts(a date which is prior to the date framework on the voucher) may only be conducted in writting through Vehicle Rent. Changing your booking may trigger a Rate / Price change, or an additional charge which may be due from a material change, such as the duration or car type.

 

11. CONFIRMATION AND RESERVATION



Article 14

In the name of a selected car rental service provider, the reservation system will issue a confirmation for each reservation, whereby the agent does not bind itself that the confirmation shall include information on the costs of additional services, local charges and costs charged by the service provider, or on additional services the user may request directly at the time of vehicle acquisition.

The agent recommends that the user checks any information regarding reservations (country, location, rental period). Noting discrepancies, the user must immediately perform changes through the reservation system, or through the agent’s client center where the user must provide correct contact detail changes or other corrections.

The agent recommends that the user reads and reviews all rental terms and conditions of car rental service provider (available in the second step of reservation process in the reservation system, when selecting vehicle type, which may occasionally change without prior notice).

Car rental service provider will execute the user’s reservation only upon receiving confirmation of vehicle reservation. The reservation number, obtained by the user upon confirming reservation serves as a reference number for all further communication with the agent (questions, reservation changes, cancellation).

12. CANCELLATION POLICY



Article 15

Cancellation Policy: a cancellation fee is applied by Vehicle Rent to any reservation canceled by the client, except in the case the cancellation is within 48 hours of the booking being placed on the website. Be advised that if you want to cancel your booking, please send your request in writing to customerservice@vehicle-rent.com. Phone cancellations will not be accepted.

1. Cancellation Policy for reservations with partial payment:

1.1. When canceling at least 48 hours in advance of your rental, administration charge of 25 EUR is not refundable. If prepayment sum charged upon confirmation is greater than that, the rest balance will be refunded in up to 45 business days of the cancellation date depending on your credit card processor's reimbursement procedures.

1. 2. When canceling less than 48 hours in advance of your rental, charge of the full prepayment amount which includes the cost of rental service and Separate Payment Handling Charge but may include also Excess Refund Fee or/and Super Excess Refund Fee is not refundable.

2. Cancellation Policy for full prepayment reservations:

2.1. When canceling at least 48 hours in advance of your rental, administration charge of 50 EUR is not refundable. The remaining sum is refunded within 45 business days of the cancellation date.

2.2. When canceling less than 48 hours in advance of your rental, administration charge from 12.5% to 25% of the reservation amount is not refundable (depending on car rental company Terms & Conditions). The remaining amount will be refunded within 45 business days of the cancellation date.

3. Cancellation Policy after the rental period has already started (e.g. if the client fails to appear at the car rental location at a specified time):

3.1. Partial prepayment as well as the cost of any prepaid extras are not refunded.

3.2. Under condition of full prepayment administration charge of 100% of the reservation amount* as well as the cost of prepaid extras are not refundable (depending on car rental company Terms & Conditions). The remaining sum will be refunded within 45 business days of the cancellation date. *In some cases, depending on car rental company Terms & Conditions, the administration charge may vary being equal up to 100% of the prepayment amount. The administration charge is used to cover business loss of the car rental company.

4. Cancellation Policy providing that client ordered Cancellation Protection:

4.1. When canceling partial and full prepayment reservations before the start of your rental: prepayment will be refunded in full within 45 business days of the cancellation date except for the cost of the Cancellation Protection and separate payment handling charge.

Cancellation may be effected only through agents the reservation system and not with the selected car rental service provider.The cancellation of reservation means that the user is cancelling also any additional services that the user has reserved through the reservation system.In the event of a cancellation or change in the reservation, the agent shall not be liable for any pecuniary loss resulting from changes in the monetary exchange rate during the time between the original reservation and the subsequent change or cancellation of reservation.

13. CANCELLATION PROTECTION


 

Article 16


“Cancellation Protection” option gives you an opportunity to cancel your booking at no cancellation administration fee (amount paid for the cancellation protection, and for the separate payment handling charge is excluded from the amount being refunded). The cost for Cancellation Protection is 6,00 EUR per rental. By purchasing it, you are guaranteed to get back your car rental prepayment no matter what the rental cost and duration is in case of canceling your booking.

"Cancellation Protection" is not valid:

1. After the rental period has already started.

2. If you cancel your booking because some of required documents (e.g. passport, driving license, credit card etc.) are missing or are not valid at the moment of executing a rental agreement on-site.

3. How to cancel your booking

3.1. We understand that your plans may change, so if you have to give up on your trip and you would like to cancel your booking please contact us via email customerservice@vehicle-rent.com. Once this is done, you will receive email confirming, that your reservation has been cancelled. Telephone cancellations cannot be accepted.

Please note that you can cancel your “Cancellation Protection” option within 24 hours from the moment of adding it to your reservation.


14. UNLIMITED AMENDMENTS AND CANCELLATION PROTECTION


 

Article 17


Unlimited Amendments and Cancellation Protection is available to purchase on the final stages of the booking process and can only be purchased at the time of booking. If Unlimited Amendment and Cancellation Protection is purchased all amendments will be subject to no further charge (usually 5 EUR per amendment) and cases where the booking is cancelled a full refund will be given (excluding the amount taken for the Unlimited Amendments and Cancellation Protection and separate payment handling charge) Unlimited Amendments and Cancellation Protection is charged at 9 EUR per rental.

Please note that you can cancel your “Unlimited Amendments and Cancellation Protection” option within 24 hours from the moment of adding it to your reservation.


15. SEPARATE PAYMENT HANDLING CHARGE

Separate payment handling charge (SPHC) is charged to subsidize the cost of payment methods other then direct remittance to the bank account of the agent. SPHC is charged per booking and only applies to the initial payment for new booking. The fee is non-refundable.

16. EXCESS REFUND OPTION

Excess Refund Option is an optional product where, when purchased on our web at the time of the reservation being made, you will be reimbursed for excess paid to our partner (rent a car) for any accidental damage made at the time of your rental. You will be also reimbursed for excess paid to our partner in case of theft of rented vehicle. Excess Refund Option is an optional product that is not an insurance. Vehicle Rent handling charge for excess refund option is 1,22 EUR (including V.A.T.) per day and is already included in the price of the product shown on our web page.

Cooling Off Period: Within 7 days of purchase: If within 7 days of purchasing this insurance you decide that it does not meet your needs, your premium will be refunded in full. If however within the 7 days you have traveled, made a claim or intend to make a claim, or if the policy has started, then the premium will not be refunded. After 7 days of purchase: If you decide to cancel the policy after 7 days of purchasing, then no refund of premium is available.

17. SUPER EXCESS REFUND OPTION


 

Article 20


Super Excess Refund Option is an optional product where, when purchased on our web at the time of the reservation being made, you will be reimbursed for excess paid to our partner (rent a car) for any accidental damage made at the time of your rental. You will be also reimbursed for excess paid to our partner in case of theft of rented vehicle. Super Excess Refund Option is an optional product that is not an insurance. Vehicle Rent handling charge for excess refund option is 2,44 EUR (including V.A.T.) per day and is already included in the price of the product shown on our web page.

What is covered?
If your hire car is involved in an accident you will be reimbursed for the excess applied by the car rental company up to EUR 3.000 for a series of incidents during any single vehicle rental agreement not covered under the collision damage waivier clause of your car hire agreement for the following:

Up to 500EUR for damage to the roof of the hire car;

Up to 650EUR for damage to the windscreen, windows or sunroof glass of the hire car;

Up to 400EUR for damage to the undercarriage of the hire car;

Up to 80EUR for damage to each tyre that needs: repalcing or up to 40EUR for each tyre that can be repaired of the hire car.

What is not covered?

Any claim where you have not followed the terms of your rental agreement;

  • Damage to the rental vehicle interior, wheels, clutch, engine, gearbox, oil pan ;
  • Mechanical failure of the rental vehicle;
  • General wear and tear;
  • Items showing as defective at the time the rental agreement commenced;
  • Driving off road;
  • When vehicle has been driven in unauthorized areas, countries;
  • When any fraudulent, dishonest or/and criminal act has been committed by the driver or/and passengers;
  • When damages occur while parking or in a parking facility;
  • Commercial use.
  • When vehicle is stolen due to the loss of keys or/and documents of the vehicle.
  • When personal belongings are stolen from the interior.
  • When parts of vehicle are stolen.
  • From the refund also any towing fees, extra costs for taxis, administrative fees of car rental supplier, overnight accommodation, public transport, additional rental car, etc. are excluded.
  • When vehicle is not returned to a car hire company employee and/or within the designated office operating hours.
  • Personal Possesions Up to 250EUR in total for your personal possesions damaged following attempted theft or stolen from the locked boot, covered luggage area or glove box of the rental vehicle, during your car hire period. The maximum amount reimbursed for any single article, pair or set is 125EUR.Note: It will be decided by the provider, taking your circimstances into account eithe: To pay the cost of rapairing your items;
  • To replace your belongings with equivalent items or to pay the cost of replacing your items.
  • What is not covered?
  • You are not covered for more then 40EUR in total for:
  • tobacco, alcohol, fragrances and perfumes;
  • Breakage of or damage to fragile articles, audio, video, computer, television, fax and phone equpiment;
  • Loss or damage due to the climate, wear and tear, loss in value;
  • A claim for more than one mobile phone unit per person insured;
  • Loss or theft of, or damage to, the following:
  • -Films, tapes, cassettes, computer games, electronic games, mini discs, DVDs, video and audio tapes, cartriges or disc.
  • -Goods which detiriorate, bottles or cartons, and any damage caused by these items or their contents.
  • -Contact or corneal lenses, unless following fire or theft.
  • -Bonds, share certificates, garantees or documents of any kind.
  • -Personal possessions unless they are on your person, or they are out of sight in the locked boot or covered luggage area or glove box of the insured vehicle.
  • -Personal money.
  • Hire Car Key Cover
  • What is covered?
  • You will be reimbursed up to 450EUR in total to replace the car hire keys if these are lost, stolen, or damaged during the rental period. This will also include, where necessary, the costs to replace locks or for locksmith to break into the rental vehicle.
  • Misfueling
  • What is covered?
  • - Draining and flushing the fuel tank on site using a specialist roadsid vehicle or
  • - Recovery of the rental vehicle, the driver and up to six passangers to the nearest repairer to drain and flush the tank with 10 litres of the correct fuel.
  • -You can claim only once per rental agreement.
  • - Reimbursement for costs up to a maximum claim of 250EUR per claim.
  • What is not covered?
  • -You will be responsible for paying any costs in excess of 250EUR per claim;
  • -Fuel, other than the 10 litres of correct fuel to replenish the fuel tank after draining and flushing out the contaminated fuel;
  • -Any claim resulting from foreign matter entering the fuel system except for diesel or petroleum;
  • -Mechanical or component damage to your rental vehicle whether or not caused as a result of misfuelling or the cost of hiring an alternative vehicle in the event mechanical or component damage is sustained;
  • -Any defect which is deemed not to be a direct result of misfuelling or a defect which existed before the incident of misfuelling;
  • -Any vehicle or vehicles other than the rental vehicle or vehicles listed on the rental agreement.
  • Tyre Puncture
  • What is covered?
  • -Up to 80EUR for damage to each tyre that needs: repalcing or up to 40EUR for each tyre that can be repaired of the hire car.
  • What is not covered?
  • -Damage or loss of steel wheels and/or alloy wheels and wheel caps is not covered.
  • Cooling Off Period: Within 7 days of purchase: If within 7 days of purchasing this insurance you decide that it does not meet your needs, your premium will be refunded in full. If however within the 7 days you have traveled, made a claim or intend to make a claim, or if the policy has started, then the premium will not be refunded. After 7 days of purchase: If you decide to cancel the policy after 7 days of purchasing, then no refund of premium is available.

    18. VEHICLE RENT GLASS & TYRE PROTECTION OPTION


     

    Article 21


    Vehicle Rent Glass & Tyre Protection Option is insurance to protect only the windshield and tires of the rental car. This policy covers nearly all windows in the vehicle, including the windshield, side windows, rear-window, mirror glass and tyres. Vehicle Rent Glass & Tyre Protection Option is an optional product where, when purchased on our web at the time of the reservation being made, you will be reimbursed for costs paid to our partner (rent a car) for any accidental damage made to above mentioned glass items and tyres at the time of your rental. If Vehicle Rent Glass & Tyre Protection Option is not accepted, the renter will be held liable for all of the damages to the windshield, side windows rear-window, mirror glass and tyres. You are covered up to EUR 3.000 for a series of incidents during any single vehicle rental agreement for the reimbursement of the excess applied by the car rental company.

    The Vehicle Rent Glass & Tyre Protection Option is an optional product that is handled by Vehicle Rent directly and is not a subject of any kind of insurance.

    19. VEHICLE RENT EASY&INCLUSIVE OPTION

    Vehicle Rent Easy&Inclusive Option is an optional product where, when purchased on our web at the time of the reservation being made or modified or by telephone, you will be purchasing a package of services Vehicle Rent is selling on behalf of the car rental provider. Easy &Inclusive product is exclusively subject to car rental provider's Terms and Conditions.

    The Vehicle Rent Easy&Inclusive Option is an optional product that is handled by Vehicle Rent directly and is not a subject of any kind of insurance.
